SMARTLEGAL MANAGING PARTNER LISTED AS ARBITRATOR AT THE VIENNA INTERNATIONAL ARBITRATION CENTER

Our Managing Partner, dr. Richard Schmidt has been listed as international arbitrator practitioner at the Vienna International Arbitration Centre, with effect from 1st January 2022.
The Vienna International Arbitral Centre (“VIAC”) is one of the leading arbitral institutions in Central and South-Eastern Europe, and on global level, too.
VIAC was established as an independent center in 1975 for the resolution of international commercial disputes, through arbitration and mediation. Since 2018, VIAC also administers domestic arbitrations in Austria; and as of 2021, VIAC has implemented a special set of rules for the settlement of investment disputes, bringing its expertise and flexibility to the effective resolution of disputes between states and state-owned entities and investors.
Our Managing Partner dr.Richard Schmidt specializes in dispute resolution, especially in commercial arbitration and litigation. Besides participating in domestic and international arbitration proceedings as counsel and arbitrator, Richard frequently publishes articles on timely and evergreen topics in international arbitration.
Being the national reporter of ICCA (International Council for Commercial Arbitration) in relation with the domestic case law of the New York Arbitration Convention published in the ICCA Yearbook of Commercial Arbitration, Richard also regularly participates in various international projects, like the ICCA Right to Physical Hearing Project, which focused on the core legal questions posed by the increased use of remote arbitral hearings due to the COVID pandemic.
It is a great honour to our Managing Partner, dr.Richard Schmidt to be listed as international arbitration practitioner by such a prestigious arbitral institution like VIAC, among so many distinguished arbitration lawyers.

SETTING ASIDE ARBITRAL AWARDS IN HUNGARY
Given that there is no right of appeal in arbitration proceedings, it is important to be aware of what other legal remedies are available to you against an arbitral award. According to the Hungarian Arbitration Act, the parties may request the competent state court to set aside the award, which is a “mandatory” remedy, which cannot be waived by the parties in advance.
